Plaintiff Gary Anderson filed a lawsuit in March 2009 based on construction defect allegations related to a complete remodel of a single family residence by the defendant general contractor. Plaintiff claimed in excess of $282,000 in construction damages mainly related to water intrusion, $131,000 in incidental damages, and $124,000 in loss of use damages. We represented the stucco subcontractor allegedly implicated in some of the water intrusion issues. The case settled in its entirety at mediation for $220,500, of which our client paid $15,000.
